By creating an account, browsing listings, posting ads, or using any part of Marketplace Naija, you agree to comply with and be legally bound by these Terms of Use and our Privacy Policy, Cookie Policy, and other related policies. These terms apply to all users, whether registered or not.

2. About Marketplace Naija

Marketplace Naija is a Nigerian online classifieds platform that allows users to buy and sell products or services through postings, promotions, and direct communication. The platform connects buyers and sellers but does not own, buy, or sell the items listed unless explicitly stated.

3. Eligibility

To use our services, you must:

• Be at least 18 years old
• Have the legal capacity to enter a binding contract
• Use the platform in accordance with Nigerian law and these Terms

We may suspend or terminate accounts that violate these criteria.

4. User Accounts

a. Registration

You must create an account to post ads or use certain features (e.g., Buy Direct, messaging). You agree to:

• Provide accurate, current, and complete information
• Keep your login credentials confidential
• Be responsible for all activity under your account

b. Account Termination

We reserve the right to suspend or permanently remove accounts for:

• Fraudulent activity
• Repeated violations of policies
• Inappropriate or abusive behavior
• Suspicion of criminal activity

5. User Responsibilities

When using Marketplace Naija, you agree to:

• Post only lawful, accurate, and non-misleading content
• Not engage in spam, harassment, or abusive conduct
• Refrain from posting stolen, counterfeit, or illegal goods
• Use our Buy Direct feature honestly and in good faith
• Report suspicious activity to our support team

6. Prohibited Items & Content

You may not post, buy, or sell any of the following:

• Weapons, explosives, or ammunition
• Narcotics or illegal drugs
• Counterfeit goods or currency
• Stolen property or unlawfully acquired items
• Adult content, pornography, or sexually explicit material
• Services promoting scams, betting, pyramid schemes, or money doubling
• Anything that violates Nigerian law or community standards

Marketplace Naija reserves the right to remove any content that violates these rules, even without notice.

7. Posting Ads

When you post an ad, you:

• Grant us a non-exclusive, worldwide license to display, promote, and distribute the content
• Confirm that you own or have permission to use any media, text, or logos included
• Agree not to repost the same item excessively (spamming)
• Must ensure all claims, images, and prices are truthful and up-to-date

We may review, approve, reject, or edit ads for policy compliance, formatting, or safety.

8. Buy Direct: Payment & Delivery

The Buy Direct feature is a secure transaction method offered by Marketplace Naija.

a. How it works:

1. Buyer pays through the platform
2. Seller ships the item within 3 working days through our logistics partner
3. Buyer confirms receipt
4. Marketplace Naija releases the funds to the seller

b. Important Conditions:

• We may withhold payments in cases of dispute, fraud, or unresolved delivery issues
• Sellers must ship or deliver within the time promised
• Buyers must inspect the item and confirm delivery promptly
• Both parties must cooperate in case of disputes

Marketplace Naija is not liable for delays, damaged goods, or misrepresentation unless the transaction was fully handled through Buy Direct which offers 100% buyer protection.

9. Paid Promotions & Billing

You may choose to promote your listings through paid features (e.g., Boosted Ads, Featured Listings). These services are billed based on the duration and visibility selected.

• All payments are final once the ad goes live
• Refunds are only issued for verified technical errors (see Billing Policy)
• Promotional content must comply with all ad rules and Nigerian law

10. Intellectual Property

All content and materials on Marketplace Naija, including the logo, design, code, and interface, are protected by copyright and intellectual property laws.

• You may not copy, distribute, or use our content without written permission
• You retain ownership of content you post, but grant us rights to use it as needed to operate the platform

11. Privacy & Data Protection

Your use of the platform is also governed by our Privacy Policy, which explains how we collect, store, and use your data in compliance with the Nigeria Data Protection Act (NDPA) 2023.

12. Disclaimers

• We do not guarantee the accuracy, quality, legality, or safety of items posted by users.
• Marketplace Naija is a platform provider, not a party to transactions (unless otherwise stated).
• We are not responsible for loss, theft, injury, or damages arising from in-person meetups or third-party services.
• Use the platform at your own risk and exercise reasonable caution.

13. Limitation of Liability

To the fullest extent permitted by law, Marketplace Naija shall not be liable for:

• Any indirect, incidental, or consequential damages
• Loss of profits, data, or goodwill
• Unauthorized access or use of your account
• Errors, outages, or platform downtime

Our liability is strictly limited to the amount paid (if any) for services directly offered by us.

14. Indemnification

You agree to indemnify and hold harmless Marketplace Naija, its directors, employees, and partners from any claims, losses, or legal fees arising out of:

• Your use of the platform
• Violation of these Terms
• Your ads, content, or interactions with other users

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Nigeria.

Any disputes shall be first resolved informally through our support team. If unresolved, they may be escalated to a competent court of jurisdiction in Nigeria, or resolved through arbitration if both parties agree.

16. Changes to Terms

Marketplace Naija reserves the right to modify these Terms at any time. When we do:
